Thank you for your interest in a pet/equine photoshoot session with Lucy Anne Lloyd Photography (“me/I/my/the photographer”). Please read these Terms and Conditions carefully, as they apply to your (“you/the client”) booking (“Photography Services/photoshoot session”). By continuing your booking you are agreeing with these terms.

1. General:

The following terms and conditions are agreed upon between both parties; Lucy Lloyd trading under Lucy Anne Lloyd Photography and the client (person participating in/booking the photoshoot and/or products). No variation or termination of these terms and conditions (or of any document referred to in it) shall be effective unless such conditions are expressly agreed by the photographer in writing.

I reserve the right to change these terms and conditions at any time. Any such changes will take affect when posted on the website (lucyannelloydphotography.co.uk) and it is the client’s responsibility to check the website regularly to see the most up-to-date T&Cs.

The client must be aged 18 years or over. Any children under the age of 18 must be accompanied by a parent/guardian.

 2. Copyright and use on social media:

All copyright of photographic images is retained by Lucy Anne Lloyd Photography. The photographer asserts the right to be credited as the author of the photos in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction or modification of any images will constitute a breach of copyright.

By agreeing to these terms, unless otherwise discussed with the photographer, the client gives their permission for final images to be displayed and to be used to promote the business on Lucy Anne Lloyd Photography’s website/social media, as examples for potential clients, advertisement and any further use deemed appropriate by the photographer. The client gives this permission on behalf of themselves and any other individuals involved in the photoshoot.

If the client objects to their final images being used as stated above, they should request deletion of the images via written request to info@lucyannelloydphotography.co.uk.

The client will be permitted to use the final images for personal use only. You are not permitted to alter the images in any way (changing colours, cropping, applying filters etc). Direct downloading or use of screen-capture from the client gallery or any other area of the website or associated social media is strictly prohibited.

3. Client’s obligations:

The animals and people who are involved in the photoshoot (both interacting and observing) will remain the client’s responsibility at all times; before, during and after the photoshoot. They are not the photographer’s responsibility at any time. You as the owner of the animal(s) agree to ensure your pet(s) are under your control at all times, to cooperate with me in all matters relating to the photoshoot and to supply me with all information reasonably requested in order to carry out the photoshoot session. If at any point you feel the safety of your pet and/or persons interacting/observing the photoshoot is compromised, you should inform the photographer immediately and the photographer will cease this action immediately. It is your responsibility to tell the photographer if you feel that the location or situation put your animal and/or persons interacting/observing in danger. Lucy Anne Lloyd Photography is not responsible for any third parties hired by the client to assist with their photoshoot (e.g. friends, family, grooms).

You agree to make me aware of any issues with your pet including but not limited to aggression, allergies, anxiety, reactiveness etc. prior to the photoshoot session. If your dog needs to stay on the lead or cannot do certain things (for medical or other reasons) you must inform the photographer. I reserve the right to decline any booking that I deem to pose a health and safety risk to you, myself, other people or pets who may be in the vicinity.

Equine session – If you choose, at your own discretion, to ride your horse without a riding hat, you do so entirely at your own risk. It is down to the client’s discretion that safety clothing is worn during the handling of horses. If the client intends to wear a dress/long billowing clothing it is the client’s responsibility to ensure that their horse is accustomed to/desensitised to the clothing. The photographer accepts no responsibility for any injury or damage caused to horse, rider, property or any third parties before, during or after the photoshoot. You as the owner/client are responsible for your horse(s) and will be liable for any damages caused by them. If the photographer deems that the situation is dangerous then the photoshoot session will be suspended immediately.

It is the responsibility of the client to ensure that any location being used has permission from the landowner(s).

4. Accidental waste:

The client will make every effort to clean up after their animal and dispose of any accidental waste that occurs before, during and after the photoshoot session. The client is responsible for bringing appropriate clean-up materials to the photoshoot session.

5. Photoshoot services and photo requests:

Each photoshoot is unique to the client(s) involved and therefore the images provided may differ to those produced by the photographer previously. The photographer retains the right to use their own discretion in terms of how the photoshoot is provided to suit the situation/animal.

Clients are encouraged to make reasonable photo requests prior to the photoshoot session. Although I will make every effort to fulfil the client’s requests for specific photographs, I may be limited by factors out of my control such as the animal’s behaviour, the weather, the light, or the client’s choice of location. The client agrees to accept these limitations and understands that not all of the desired images may be possible.

6. Booking and payment:

The client should contact Lucy Anne Lloyd Photography in writing at info@lucyannelloydphotography.co.uk to confirm availability for the date they require before booking their photoshoot. The booking will not be confirmed until the photographer has confirmed availability in writing for the requested date. The client is required to pay a non-refundable deposit equal to 20% of the full cost of the agreed package in order to secure their booking. Once the client has made a booking for a specific time and date, which has been confirmed by the photographer, and the deposit payment has been received, the photographer will not accept any other work from other clients for those times and dates.

Upon booking the photoshoot, you will be sent an invoice by the photographer with payment details. Payment for the photoshoot must be received in full on the day of the photoshoot, before it commences. Additional prints or products (not included in the chosen package) may be ordered separately. The full balance for products (prints, canvases etc.) must be paid in full before they will be ordered on your behalf. Due to the custom nature of photographic products, once your order has been placed it cannot be cancelled, amended or refunded.

7. Additional fees:

Any fees associated with the location that the client has chosen (admission fees, parking, etc.) are the responsibility of the client and will be paid by the client directly to the location. The photographer will not guarantee or arrange payment on any location on behalf of the client. The photographer agrees to perform photography services within a 25 mile radius of Pembroke Dock (as defined on google maps). Photoshoot locations outside of this 25 mile radius will be charged an additional £0.45 per mile.

8. Post-processing:

Following the completion of the photoshoot, the images taken by the photographer will be reviewed and edited to produce the final images. Only the best images will be selected at the photographer’s discretion and carefully edited to the photographer’s artistic satisfaction. Images that do not meet the photographer’s satisfaction are deleted from the system.

The photographer will aim to provide a preview of one final image within one week from the date of the photoshoot. This preview may be displayed on the website (lucyannelloydphotography.co.uk) or on the associated social media pages. The client agrees to the preview being displayed as described above. If the client does not wish the preview to be displayed as described above, they should inform the photographer in writing to info@lucyannelloydphotography.co.uk.

The photographer aims to provide the final images for viewing in an online password protected gallery within 3 – 4 weeks from the photoshoot date. The photographer will contact the client to let them know when the images are ready. The timescale for editing the final images will vary depending on the photographer’s schedule and other commitments. This timescale does not include the time taken for products to be produced and dispatched to the client. The client will have access to this gallery for 14 days. During this 14 days period the client is to make all decisions on what images they would like for prints or products before being archived. There is a fee of £15 to rehost your online gallery after the 14 days preview period. A reactivated gallery will remain online for 3 days.

The client understands that all final images will be produced in chronological order from the date of the photoshoot in relation to other clients and the date of their photoshoot. All digital images will be provided in JPEG format. No RAW files or unedited files will be released.

In the unlikely event that the client is not happy with the images from their session there is no obligation to purchase any images, products or digital images. The session fee however will not be refunded.

9. Cancellation, non-attendance and change of dates:

The photographer reserves the right to cancel the photoshoot under certain weather conditions (e.g. rain, snow, high winds, etc.), where it would be unsafe for the client, animal or photographer to go ahead with the photoshoot or where it would cause potential damage to the photographer’s equipment. If the photoshoot has to be cancelled by the photographer, the client will be contacted via email at least 2 hours before the photoshoot is scheduled to start. If the photoshoot is cancelled, the photographer will make every effort to arrange the next suitable date for both parties. If a suitable date cannot be arranged to suit both parties, then all monies paid towards the session will be refunded to the client in full.

If the photographer is unable to attend due to illness, injury, bereavement, travel delays and/or other unforeseen circumstances, the photographer will rearrange the photoshoot to an alternative available date to suit both parties. If this is not possible, the client will be provided with a full refund.

The client may cancel their photoshoot booking up to 72 hours before the agreed date of the photoshoot without incurring any additional fee. Cancellation within 72 hours from the date of the photoshoot will result in all monies paid being forfeited to the photographer. If a cancellation is requested it should be submitted in writing via email to info@lucyannelloydphotography.co.uk.

If the client does not attend their photoshoot session on the agreed date at the agreed location, this will result in forfeit of all monies paid to the photographer.

The photographer may waive cancellation fees under extenuating circumstances at their own discretion and will review such cancellations on a case by case basis.

If the client wishes to change the date of the photoshoot, they should request this in writing to info@lucyannelloydphotography.co.uk. This request is not confirmed until the client receives a reply from the photographer stating that the change of date request has been approved. If the date has been changed to suit both parties at least 72 hours prior to the original photoshoot date, the deposit and all monies paid will be transferred to the new date. If the date is changed within 72 hours from the original photoshoot date, there may be an additional charge at the photographer’s discretion. The new photoshoot date must be within one year from the original date. The client may reschedule the photoshoot up to 3 times only, after which all monies paid will be forfeited to the photographer. If a suitable date cannot be agreed between both parties then the terms of cancellation shall apply.

10. Limited liability:

The photographer takes the utmost care with digital files, storage discs, memory cards, other photographic equipment/computer equipment and final images. However, in the unlikely event that images have been lost, stolen, lost or damaged in the mail, through camera malfunction, computer malfunction or destroyed for reasons beyond the photographer’s control, the photographer’s liability is limited to a full refund of all payments received or a replacement photoshoot can be scheduled with the client and the same animals as in the original shoot, free of charge to the client.

Lucy Anne Lloyd Photography holds Public Liability and Professional Indemnity Insurance.

11. Gift vouchers/cards:

Unless otherwise stated, the term “gift voucher” refers to physical gift cards, e-gift cards, physical gift vouchers and e-gift vouchers. Gift vouchers may be purchased for yourself or for another person to the value of £40, £65 or £100. By purchasing or using a gift voucher the client (person buying the gift voucher) is indicating that they agree to all of the terms and conditions in this agreement. It is the responsibility of the purchaser to inform the intended user of the gift voucher that usage of the voucher is subject to these terms and conditions. Lucy Anne Lloyd Photography reserves the right to contact the person/people involved in the photoshoot and ask them to read and agree to these terms and conditions independently of the person who purchased the gift card.

The gift voucher will be sent to the purchaser within 7 days of the order being placed. Due to the personalised nature of this gift voucher, please be aware this time is required as each gift voucher is designed and sent by the photographer individually and is not created automatically.

The gift vouchers are valid for 12 months from date of purchase unless otherwise stated. Each gift voucher has a unique code which will automatically expire after the 12 month period and cannot be reactivated. You will not be sent reminders to inform you that your gift card is about to expire. It is your responsibility to ensure that the balance is used before it expires. The code displayed on the gift voucher may only be used once.

Gift vouchers are not a credit, debit or cheque guarantee card and cannot be redeemed for cash. Gift vouchers cannot be returned and they are non-refundable. This does not affect your statutory rights. Gift vouchers cannot be used for the purchase of additional gift vouchers.

Gift vouchers must be treated like cash. Lucy Anne Lloyd Photography is not responsible for loss, stolen or damaged gift vouchers and they will not be replaced. You will not earn interest on the balance of a gift voucher.

All photoshoots must be within the radius stated in these terms and conditions (point 7). Photoshoot sessions outside of this radius may incur additional charges.

Lucy Anne Lloyd Photography reserves the right to decline or withdraw gift vouchers, and the right to amend these terms and conditions at any time.

Gift vouchers are only sold to and can only be used by residents of the UK.
